Tessella Magnetic Tiles — Terms of Service

Welcome to Tessella Magnetic Tiles (“Tessella”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, store, products, and services (the “Services”). Our store is hosted on Shopify Inc. By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1) Eligibility & Accounts

  • You confirm you are the age of majority in your province/territory, or you have parental/guardian consent.

  • Provide accurate, current, and complete information. You’re responsible for safeguarding your account and all activity under it.

2) Products & Descriptions

  • We aim to display products accurately; colours/appearance may vary by device.

  • Products, features, and prices may change without notice. Availability is not guaranteed.

3) Orders, Prices & Payment

  • Your order is an offer to buy; acceptance occurs when payment is processed and we confirm the order.

  • Prices are shown in CAD unless stated otherwise. Applicable taxes and shipping are calculated at checkout.

  • We may refuse/cancel orders (e.g., suspected fraud, bulk/resale).

  • We accept major cards and Shopify-supported payment methods; you agree to keep billing info up to date.

4) Shipping & Delivery (Canada Only)

  • Orders are processed within 1–2 business days (Mon–Fri, BC stat holidays excluded).

  • We ship within Canada only. Delivery timeframes are estimates and not guaranteed.

  • Title and risk pass to you when the carrier marks the package delivered. We are not liable for delays or issues after delivery confirmation.

5) Returns, Refunds & Warranty (Canada Only)

  • You may request a return within 30 days of delivery; items must include all components and original packaging.

  • Contact tessella.magtiles@gmail.com for authorization and a prepaid return label (Canada only).

  • Returns are processed within 7–10 business days after receipt.

  • Tessella products include a 1-year limited warranty covering manufacturing defects under normal use. Warranty doesn’t cover misuse, accidents, modifications, or normal wear and tear.

6) Intellectual Property

Site content (text, images, logos, designs, etc.) is owned by Tessella or licensors and protected by law. You may use the Services for personal, non-commercial purposes only. No copying, distribution, or derivative works without prior written consent.

7) Third-Party Tools & Links

We may provide access to third-party tools/sites (e.g., payment gateways, apps). Use is at your own risk and governed by third-party terms. We’re not responsible for third-party content or services.

8) Prohibited Uses

Do not use the Services to violate laws, infringe IP, harass/abuse others, upload malware, misrepresent identity, scrape, spam, or otherwise interfere with security or operations. We may suspend/terminate access for violations.

9) Disclaimer of Warranties

Except as expressly stated (including our 1-year warranty), the Services and products are provided “as is” and “as available.” We do not warrant uninterrupted, timely, secure, or error-free operation.

10) Limitation of Liability

To the fullest extent permitted by law, Tessella and our affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages (e.g., lost profits/data). Our aggregate liability is limited to the amount you paid for the product giving rise to the claim.

11) Indemnification

You agree to indemnify and hold Tessella and our partners harmless from claims, losses, or expenses arising from your breach of these Terms, misuse of the Services, or violation of law/third-party rights.

12) Termination

We may suspend or terminate access at any time for breach or misuse. Sections that by nature survive (e.g., IP, warranty disclaimers, limits of liability, indemnity) remain in effect.

13) Governing Law & Venue

These Terms are governed by the laws of British Columbia, Canada, and applicable federal laws. You consent to the exclusive jurisdiction and venue of the courts in British Columbia.

14) Changes to These Terms

We may update these Terms by posting a revised version with a new “Last Updated” date. Your continued use of the Services constitutes acceptance of changes.
